保定市人民政府作為主辦單位，保定市競秀區人民政府、保定市自然資源和規劃局作為承辦單位，保定市自然資源和規劃局競秀區分局、河北銘秀置業(yè)有限公司作為征集人現舉辦“保定市競秀區八大廠(chǎng)老工業(yè)區重點(diǎn)廠(chǎng)區城市設計國際方案征集”活動(dòng)。本次方案征集活動(dòng)將公開(kāi)邀請具有相關(guān)規劃設計經(jīng)驗和產(chǎn)業(yè)研究與策劃經(jīng)驗的機構前來(lái)申請應征，提交資格預審申請文件（以下簡(jiǎn)稱(chēng)“申請文件”）。通過(guò)資格預審選取3個(gè)應征人參加征集活動(dòng)，并提交應征設計成果。
　　The Baoding Municipal People's Government as the Sponsor,the People's Government of Jingxiu District,Baoding City and the Baoding Natural Resources and Municipal Planning Bureau as the Organizers,and the Jingxiu District Branch of Baoding Natural Resources and Municipal Planning Bureau and Hebei Mingxiu Real Estate Co.,Ltd.as the Solicitors are currently holding the International Solicitation for Urban Design Proposals for Key Factory Areas in Badachang Old Industrial Zone,Jingxiu District,Baoding City.The solicitation aims to publicly invite institutions with pertinent planning and design experience,along with expertise in industry research and planning,to apply and submit the Application Documents for Prequalification(hereinafter referred to as“Application Documents”).The Sponsor will select three final applicants as Participants for solicitation of proposals and for them to further submit their design proposals for response.

　　1.2項目位置：八大廠(chǎng)老工業(yè)區位于保定市競秀區，保定市區西部。距離雄安新區50公里，距北京160公里，距天津180公里，距石家莊140公里，與京津石構成一小時(shí)經(jīng)濟圈。距離保定市人民政府約5公里，周邊區域發(fā)展蓬勃，西部文體新城、環(huán)城水系和園博園共同推動(dòng)了該區域的發(fā)展。
　　1.2 Project Location:The Badachang Old Industrial Zone is situated in Jingxiu District of Baoding,specifically in the western part of Baoding City.It lies 50 kilometers from Xiongan New Area,160 kilometers from Beijing,180 kilometers from Tianjin,and 140 kilometers from Shijiazhuang,forming a one-hour economic circle with these cities.Approximately 5 kilometers from Baoding Municipal Government,the surrounding areas of the Zone are booming driven jointly by the Western Cultural and Sports New Town,the ring-shaped water system,and the Garden Expo Park.

　?。?）The urban design scope of the key factory areas includes three disused factories:the southern vacant plot of Lucky Film Factory,Datang Baoding Co-generation Power Plant,and Baoding Chemical Fiber Factory,approximately 2,000 mu（133.33 hectares）.Additionally,there is a 500 mu（33.33 hectares）area north of the chemical fiber factory dedicated to urban aesthetic coordination,with a total area of approximately 2500 mu（166.67 hectares）.The specific scope and area shall be subject to the solicitation documents.

　　4.應征申請人的資格
　　4.Eligibility and Qualifications of Applicants
　　4.1應征申請人（以下簡(jiǎn)稱(chēng)“申請人”）應為合法注冊的法人實(shí)體或由合法注冊的法人實(shí)體組成的項目聯(lián)合體。
　　4.1 Any prequalification Applicant(hereinafter referred to as"Applicant")shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.
　　4.2申請人應具有承擔本征集項目規劃設計和相關(guān)產(chǎn)業(yè)研究與策劃的專(zhuān)業(yè)技術(shù)能力。
　　4.2 Applicants should have the professional technical expertise necessary for the planning,design,and relevant industrial research and planning of this solicitation project.

　　4.2.1.2中華人民共和國境外的設計機構須依其所屬?lài)蛩鶎俚貐^的管理規定具有城市規劃或建筑設計的執業(yè)許可或經(jīng)營(yíng)許可。
　　4.2.1.2 Design entities outside the People's Republic of China must possess a professional license or business permit for urban planning or architectural design according to the regulations of their respective country or region.
　　4.2.2相關(guān)產(chǎn)業(yè)研究與策劃專(zhuān)業(yè)技術(shù)能力要求如下：
　　4.2.2 The requirements for professional technical capabilities in relevant industrial research and planning are as follows:
　　申請人應具有相關(guān)產(chǎn)業(yè)研究與策劃的經(jīng)驗和業(yè)績(jì)，并能提供與此相關(guān)的證明資料。
　　Applicants should have relevant experience and accomplishments in industrial research and planning,and be able to provide supporting documentation accordingly.
　　4.3中華人民共和國境外的申請人須與境內的申請人組成聯(lián)合體應征。
　　4.3 Any applicant outside the People's Republic of China must form a Consortium with an applicant inside the People's Republic of China for application.
　　4.4香港、澳門(mén)特別行政區和臺灣地區的規劃設計機構的資格要求參照境外設計機構資格要求的規定。
　　4.4 The qualifications required for planning and design entities from the Hong Kong and Macau Special Administrative Regions,as well as Taiwan,shall follow the provisions regarding the qualifications for design entities outside the People's Republic of China.
　　4.5本項目接受聯(lián)合體應征。
　　4.5 This Project accepts applications from Consortia.
　　4.5.1聯(lián)合體的各成員應共同簽署一份聯(lián)合體協(xié)議。
　　4.5.1 Partners of a Consortium shall jointly sign a consortium agreement。
　　4.5.2聯(lián)合體各成員方均應當具備其承擔的征集項目設計或研究的相應專(zhuān)業(yè)技術(shù)能力，且應當具備相應資質(zhì)/資格條件。由同一專(zhuān)業(yè)的單位組成的聯(lián)合體，按照資質(zhì)或資格等級較低的單位確定聯(lián)合體的資質(zhì)或資格等級。
　　4.5.2 Each Partner of the Consortium shall possess the corresponding professional technical capabilities required for the design or research of the solicitation project they undertake,and shall have the corresponding qualifications.For a Consortium composed of units from the same profession,the consortium's qualification level shall be determined based on the unit with the lower qualification level.
　　4.5.3組成項目聯(lián)合體的各成員單位不得再以自己的名義單獨申請應征資格預審，也不得同時(shí)加入本項目其它聯(lián)合體申請應征資格預審。
　　4.5.3 Members of the project consortium shall not apply separately for prequalification under their own name,nor shall they simultaneously join other consortia for prequalification under this Project.
　　4.6除聯(lián)合體內部的成員外，參加征集的應征人之間不應存在關(guān)聯(lián)關(guān)系。
　　4.6 Except for partners of a Consortium,the Participants in the solicitation shall not constitute or bear any affiliations.

　　有意向參加應征的申請人需先在北京科技園拍賣(mài)招標有限公司網(wǎng)站（www.bkpmzb.com）下載資格預審文件領(lǐng)取登記表，填寫(xiě)完成后以Word版本發(fā)送電子郵件至征集指定郵箱kjysanbu 163.com或遞交至征集組織機構，征集組織機構收到登記表后，再將資格預審文件的下載密碼發(fā)送給申請人。

　　9.1 Intellectual Property Rights(IPRs)
　　9.1.1本次方案征集中接收的所有有效的應征文件（包括A3版面設計文冊、A0標準輕質(zhì)展板、模型、電子文件和應征設計方案著(zhù)作權聲明等）均不退回。
　　9.1.1 All valid response proposals received in this solicitation(including the A3-sized design book,A0 standard lightweight exhibition panels,models,electronic documents,and the Copyright Statement of Design Proposals)will not be returned.
　　9.1.2應征設計文件和設計成果的知識產(chǎn)權由主辦單位、承辦單位、征集人與應征人共同享有：
　　9.1.2 The intellectual property rights(IPRs)of the Design Proposals and design results shall be commonly owned by the Sponsor,the Organizers,the Solicitors,and the Participants.
　　9.1.2.1應征人對其應征設計文件享有署名權，在征得主辦單位/承辦單位/征集人書(shū)面同意后可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評價(jià)、展示其應征設計文件的相關(guān)內容。除應征人的設計標準、設計導則和繪圖元素以外，應征人不得將應征設計文件及設計成果用于其他的設計項目。
　　9.1.2.1 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications,trade magazines,publications among others after granted with the Sponsor’s/Organizers’/Solicitors’consent in writing.The Participants shall not use the Design Proposal and design results on other design projects,except the Participant’s design standards,design guidelines,and drawing elements.
　　9.1.2.2主辦單位/承辦單位/征集人有權在本項目的規劃設計中使用應征人提交的規劃設計成果，主辦單位/承辦單位/征集人在項目的規劃設計中或在規劃設計方案調整綜合時(shí)可以全部或部分使用應征規劃設計成果的內容，也可以對其進(jìn)行修改。主辦單位/承辦單位/征集人不得將應征設計文件及設計成果用于本項目以外的其他項目。
　　9.1.2.2 The Sponsor/Organizers/Solicitors have the right to use the planning and design results submitted by the Participants in the planning and design of this Project.The Sponsor/Organizers/Solicitors are allowed to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and have the right to modify them.The Sponsor/Organizers/Solicitors shall not use the Design Proposals and design results for a purpose other than this Project.
　　9.1.2.3主辦單位/承辦單位/征集人可以對所有應征設計文件及設計成果印刷、出版和展覽，并可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評價(jià)、展示、宣傳應征設計文件及設計成果，但應注明設計機構的名稱(chēng)。
　　9.1.2.3 The Sponsor/Organizers/Solicitors can print,publish and exhibit all the Design Proposals and design results,or comment on,display and publicize the Design Proposals and design results via media communications,trade magazines,publications or by other means.The precondition is indication of the names of design entities for such design.
　　9.1.2.4應征建筑設計方案（如果有）的著(zhù)作權歸屬于應征人，但景觀(guān)小品及其建構筑物除外。
　　9.1.2.4 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.
　　9.1.3應征人應保證提交的應征設計文件及設計成果在中華人民共和國境內或境外沒(méi)有且不會(huì )侵犯任何其他人的知識產(chǎn)權（包括但不限于著(zhù)作權、專(zhuān)利權）或專(zhuān)有技術(shù)或商業(yè)秘密。應征人應保證，如果其應征設計文件使用或包含任何其他人的知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密，應征人應已經(jīng)獲得權利人的合法、有效、充分的授權。應征人因侵犯他人知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密所引起的全部賠償責任應由應征人承擔。
　　9.1.3 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patent right)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others,the Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or proprietary technologies or trade secrets of others.
　　9.2應征設計補償金
　　9.2 Compensations for Designs Proposals
　　征集人將向按照征集文件的要求在規定的時(shí)間內提交了有效應征文件的應征人支付應征設計補償金，金額為人民幣135萬(wàn)元（含稅）。當應征人出現下列情況時(shí)，征集人將不予支付補償金：
　　The Solicitors will pay Compensations for Design Proposals in the amount of RMB 1.35 million(including tax)for any Participant that has submitted valid response documents within specified timeframe as required in the Solicitation Documents.The Solicitors will not provide any compensation to Participants under the following circumstances:
　?。?）應征人未能在征集文件規定的時(shí)間內提交應征文件；
　?。?）Participants fail to submit their response documents within the specified time as stated in the Solicitation Documents;
　?。?）應征人提交的應征文件被應征設計方案評審專(zhuān)家委員會(huì )認定為未對征集文件的要求作出實(shí)質(zhì)性響應；
　?。?）The response documents submitted by Participants are judged,by the Jury for Design Proposals,as not substantially responding to the requirements of the Solicitation Documents;
　?。?）應征人被取消應征資格。
　?。?）Participants are disqualified.
　　9.3獎項的設置和優(yōu)化費用
　　9.3 Award setting and optimization fee
　　本次方案征集將評選出一個(gè)優(yōu)勝設計方案，其應征設計方案被選為優(yōu)勝方案的應征人須根據主辦單位/承辦單位/征集人的優(yōu)化設計要求對其提交的設計方案進(jìn)行優(yōu)化，優(yōu)化費用為人民幣39萬(wàn)元（含稅）。
　　One winning design proposal will be selected in this solicitation.The Participant whose design proposal is chosen as the winning design proposal shall optimize his submitted design proposal according to the optimization requirements of the Sponsor/Organizers/Solicitors.The optimization fee is RMB 390,000(tax inclusive).
　　9.4補償金和優(yōu)化費用的支付
　　9.4 Payment of compensations and optimization fee
　　應征人的補償金及優(yōu)化費用以人民幣支付。如境外應征人在中華人民共和國境內沒(méi)有常設機構，也沒(méi)有可以接受人民幣的中華人民共和國境內賬戶(hù)，可委托中華人民共和國境內的收款人全權處理收付款事宜，并為其代繳各種中華人民共和國境內稅費，由此而產(chǎn)生的相關(guān)費用由應征人自行承擔。
　　Payment of compensations and optimization fee will be made in RMB.In the case where an overseas Participant has neither permanent institution nor domestic account within the People’s Republic of China to accept RMB,a domestic payee within the People’s Republic of China may be authorized to handle payment matters in full powers and be entrusted to withhold/pay various taxes within the People’s Republic of China.The relevant expenses incurred shall be borne by the Participant.

　　本次征集活動(dòng)本身及與本次活動(dòng)相關(guān)的文件所適用的法律和法規僅為中華人民共和國的法律和法規。
　　The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
　　9.6語(yǔ)言
　　9.6 Languages
　　資格預審文件以及與資格預審文件相關(guān)的補充文件和澄清文件均使用中文和英文書(shū)寫(xiě)。申請文件應使用中文書(shū)寫(xiě)，申請人隨申請文件提供的證明文件和印刷品可以使用另一種語(yǔ)言，但應附中文譯本。在中文與其他語(yǔ)言的意思表達不一致時(shí)，以中文為準。
　　The language used in the Prequalification Documents and supplement documents and clarification documents thereto shall be Chinese.Application Documents for Prequalification shall be drafted in Chinese and English.Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents,but the version with Chinese translation shall be attached thereto.In the case of inconsistent expressions in both Chinese and another language,the Chinese version shall prevail.
