上海國際招標有限公司受上海市經(jīng)濟和信息化委員會(huì )、上海市規劃和自然資源局（以下簡(jiǎn)稱(chēng)“指導單位”）和東浩蘭生（集團）有限公司（以下簡(jiǎn)稱(chēng)“征集人”）的委托，作為征集代理，上海市城市規劃設計研究院作為技術(shù)支持單位，就上海工業(yè)博物館概念方案組織開(kāi)展國際征集活動(dòng)，歡迎有興趣參與應征的申請人參加本次征集活動(dòng)。本次征集將通過(guò)公開(kāi)資格預審的方式從所有申請人中擇優(yōu)選取6名應征人參加征集。
　　Entrusted by Shanghai Municipal Commission of Economy and Informatization,Shanghai Municipal Bureau of Planning and Natural Resources(“Supervisor”）and Donghao Lansheng(Group)Co.,Ltd(“Sponsor”）as the Solicitation Agency,Shanghai International Tendering Co.,Ltd.(“SITC”)is organizing the International Solicitation for Conceptual Scheme of Shanghai Industrial Museum(“Project”).Shanghai Urban Planning&Design Research Institute is the technical support unit.SITC welcomes all Applicants who are interested in this Project to participate.Through open prequalification,six applicants(“Shortlisted Applicants”)will be selected to enter the following Solicitation Stage.

　　2.1基地情況Base situation
　　項目選址位于黃浦區浦西世博園區文化博覽區（以下簡(jiǎn)稱(chēng)“文博區”），北側為龍華東路，南側為城市綠地及黃浦江，東側為現狀建筑船舶館，西側為城市綠地及西藏南路隧道以及江南造船廠(chǎng)船塢。地塊與世博軸隔江相望，是黃浦江世界級濱水會(huì )客廳核心區段文化底蘊最深厚、公共活動(dòng)多元的地區。
　　The project is located in the Cultural Expo Area of the Puxi World Expo Park in Huangpu District("the Cultural Expo Area"),with Longhua East Road on the north side,urban green space and Huangpu River on the south side,current building the Shipping Pavilion on the east side,urban green space and Tibet South Road Tunnel and Jiangnan Shipyard Dock on the west side.The plot faces the Expo Axis across the river,making it the area with the deepest cultural heritage and diverse public activities in the core section of the world-class waterfront event living room of the Huangpu River.

　　基地內北部翻譯館為上海市文物保護單位、西北角有西藏南路越江隧道通風(fēng)管井設施及地上排風(fēng)井；西側有臨時(shí)建筑電競館；現存承載世博會(huì )記憶的弧形高架步道。
　　The Translation House in the northern part of the base is a Shanghai Cultural Relics Protection Unit,and there are ventilation tube wells and above ground exhaust shafts in the northwest corner of the Tibet South Road Cross River Tunnel.On the west side,there is a temporary building called the esports hall.There is an existing curved elevated walkway carrying the memory of the World Expo.

　　2.2規劃要求Planning requirements
　　依據《上海市世博會(huì )地區文化博覽區控制性詳細規劃》，本次項目為規劃102-14地塊，用地面積33335平方米。地塊以文化、商業(yè)等公共功能為主，容積率為三級強度分區（2.0-2.5），建筑高度為三級分區（24-50米），保留翻譯館作為公共功能。除明確的地塊指標外，建筑布局遵循南低北高原則，沿江一側控制在24米高度以下，建筑高度原則上不超過(guò)東側的船舶館（40米），如有特定裝置或設備需要可以適當突破。
　　According to the"Detailed Control Plan for the Cultural Expo Area of the Shanghai World Expo",this project is planned to be Plot 102-14 with a land area of 33335 square meters.The plot is mainly designed for cultural,commercial and other public functions,with a plot ratio of Level 3 intensity zoning(2.0-2.5)and a building height of Level 3 zoning(24-50 meters).The Translation House is retained as a public function.In addition to clear land indicators,the architectural layout follows the principle of low in the south and high in the north.The height of the building along the river is controlled below 24 meters,and the height of the building should not exceed the Shipping Pavilion on the east side(40 meters).If there are specific devices or equipment needs,they can be appropriately broken through.

　　2.3征集內容Solicitation content
　　2.3.1征集流程Solicitation process
　　第一階段：6名入圍應征人在提交了概念方案成果后，方案評審委員會(huì )將從6個(gè)方案中評選出前3名。
　　Phase 1:After the six Shortlisted Applicants submit the conceptual scheme deliverables,the Scheme Review Committee will select the top three from the six.
　　第二階段：前3名應征人將進(jìn)行深化概念方案設計，并提交全套深化概念方案成果，最后征集人結合各方的意見(jiàn)從前3名中確定1名優(yōu)勝單位。
　　Phase 2:The top three applicants will conduct the deepening conceptual schematic design and submit a complete set of deepening conceptual scheme deliverables.Finally,the Sponsor will determine one winner from the top three based on the opinions of all parties.
　　2.3.2設計內容Design content
　　本次方案征集包括整體研究范圍和重點(diǎn)設計范圍。

　　在文博區128公頃規劃范圍基礎上，擴大整體研究范圍面積約為214公頃，東至花園港路、西至魯班路、南至黃浦江、北至龍華東路-高雄路-中山南一路-半淞園路，打造以工業(yè)博物館為核心，串聯(lián)一體兩翼的文化活動(dòng)集聚區。
　　On the basis of the 128 hectare planned area of the cultural and museum district,the overall research scope will be expanded to approximately 214 hectares,extending to Huayuangang Road in the east,Luban Road in the west,Huangpu River in the south,Longhua East Road,Kaohsiung Road,Zhongshan South No.1 Road,and Bansongyuan Road in the north,to create a cultural activity gathering area with the industrial museum as the core and connecting one body and two wings.

　　重點(diǎn)設計范圍面積約為44公頃，西至3號船塢（潛艇博物館），東至苗江路，北至高雄路-中山南一路，南至黃浦江，打造充滿(mǎn)活力的開(kāi)放街區和濱江文化新地標。
　　The key design scope covers an area of approximately 44 hectares,extending from Dock 3(Submarine Museum)to the west,Miaojiang Road to the east,Kaohsiung Road and Zhongshan South No.1 Road to the north,and Huangpu River to the south,creating a vibrant open street and a new cultural landmark of riverside.
　　2.3.3成果要求Deliverables requirements
　　第一階段概念方案成果：A3文本（其中效果圖不少于6張）、A3簡(jiǎn)本、3張A0豎板和電子文件。
　　Conceptual scheme deliverables(Phase 1):A3 Booklets(including no less than 6 renderings),A3 booklets(simplified),3 A0 vertical boards and electronic documents.
　　第二階段深化概念方案成果：A3文本（其中效果圖不少于10張）、A3簡(jiǎn)本、6張A0豎板、1:1000整體研究模型、1:300建筑單體模型、5分鐘左右多媒體（其中動(dòng)畫(huà)不小于1分鐘）和電子文件。
　　Deepening conceptual scheme deliverables(Phase 2):A3 Booklets(including no less than 10 renderings),A3 booklets(simplified),6 A0 vertical boards,1:1000 overall research model,1:300 building model,about 5 minutes of multimedia(with animation no less than 1 minute)and electronic documents.
　　3.1申請人須具有獨立承擔民事責任的能力，不接受自然人參與應征。
　　An Applicant must have the ability to bear civil liability independently,and the participation of natural person is not accepted.
　　3.2申請人須在其所在國家或地區合法注冊，且具有相應設計或設計咨詢(xún)能力。
　　An Applicant must be legally registered in its country or region and have the corresponding design or design consulting capacity.
　　3.3申請人須具有與本次征集內容類(lèi)似的項目業(yè)績(jì)（類(lèi)似的項目業(yè)績(jì)指博物館等文化類(lèi)建筑設計或設計咨詢(xún)業(yè)績(jì)，下同）。
　　Applicants must have relevant project performances similar to this Project(similar project performance refers to the design or design consulting performance of cultural buildings such as museums,same hereinafter).
　　3.4本項目接受聯(lián)合體參與競爭，聯(lián)合體成員數量不得超過(guò)3家。如申請人為聯(lián)合體，應以建筑設計單位作為聯(lián)合體牽頭人，聯(lián)合體的所有成員均須滿(mǎn)足本公告第3.1條和第3.2條的要求，聯(lián)合體牽頭人須滿(mǎn)足本公告第3.3條的要求。聯(lián)合體各方不得再以自己名義單獨參與本次征集活動(dòng)，也不得同時(shí)加入參與本次征集活動(dòng)的其他聯(lián)合體，否則，相關(guān)《申請文件》均被否決。
　　The Consortium is accepted in this Project.The number of members of the Consortium shall not exceed three.If the applicant is a consortium,the architectural design unit should be the leader of the Consortium.All members of the consortium must meet the requirements of Article 3.1 and Article 3.2 of this Announcement,and the leader of the Consortium must meet the requirement of Article 3.3.Each member to the Consortium shall not participate in this Solicitation alone in their own name,nor shall they join other Consortia participating in this Solicitation at the same time.Otherwise,the relevant Application Document shall be rejected.
　　4.1凡有意參加本次方案征集活動(dòng)的潛在申請人，請于2023年9月4日14:00時(shí)至2023年9月10日16:00時(shí)（北京時(shí)間，下同），在上海國際招標有限公司網(wǎng)站（www.shabidding.com，下同）在線(xiàn)領(lǐng)取《資格預審文件》。
　　All potential Applicants who are interested in participating in this Project can download the Prequalification Document through SITC Website(www.shabidding.com)from 14:00 September 4th,2023 to 16:00 September 10th,2023(Beijing Time,same hereinafter).
　　4.2申請人首次使用上海國際招標有限公司網(wǎng)站需完成注冊程序。已注冊的申請人可使用已獲取的供應商登錄名和密碼登錄并從網(wǎng)站采購公告欄的相應公告中進(jìn)入，點(diǎn)擊右上角“領(lǐng)購”按鈕下載《資格預審文件》。征集代理不接受沒(méi)有在上海國際招標有限公司網(wǎng)站上注冊和沒(méi)有《資格預審文件》下載記錄的申請人提交的《申請文件》。如申請人為聯(lián)合體，則聯(lián)合體中任一成員進(jìn)行注冊并有《資格預審文件》下載記錄即可，無(wú)需在《資格預審文件》的獲取階段明確聯(lián)合體組成。聯(lián)合體組成以提交的資格預審《申請文件》為準。
　　Applicants who have never used SITC Website before shall finish the registration process first.Registered Applicants can download the Prequalification Document by clicking the“purchase”button in the corresponding announcement webpage on the purchase bulletin board of SITC Website after logging in.SITC will not accept the Application Documents submitted by the Applicants who have not registered on SITC Website or who have no download records of the Prequalification Document on SITC Website.The Consortium’s application document shall be accepted if any one of the members of the Consortium has registered and has download record of the Prequalification Document.There is no need to clarify the composition of the Consortium at the stage of Prequalification Document Acquisition.The composition of the Consortium shall be specified in its submitted Application Document.
　　4.3申請人成功領(lǐng)取《資格預審文件》并不意味著(zhù)其資格條件符合要求。申請人是否符合本公告第3條“合格申請人資格條件”由資格預審評審委員會(huì )判定。
　　An Applicant's successful acquisition of the Prequalification Document does not mean that it is eligible for this Project.Whether an Applicant meets the requirements of Article 3 in this Announcement is determined by the Prequalification Jury.
　　5.1資格預審《申請文件》應以電子文件和紙質(zhì)文件的形式提交。提交截止時(shí)間為2023年9月11日11:00時(shí)，提交的時(shí)間以電子文件上傳成功的時(shí)間為準。除了在截止時(shí)間前成功上傳的《申請文件》外，未在截止時(shí)間前上傳或以其他形式提交的《申請文件》一律不被受理。
　　The Application Document shall be submitted in Electronic Documents as well as Paper Documents.The submission deadline of Application Document is September 11th,2023.The submission time of every Applicant is subject to the time when its Electronic Documents are successfully submitted.Any late submission or submission in any other form will not be accepted.
　　5.2電子文件包括全套正本《申請文件》的PDF掃描件和PPT文件。申請人應在上海國際招標有限公司網(wǎng)站本項目的領(lǐng)購頁(yè)面下，點(diǎn)擊“投標文件”按鈕后上傳資格預審《申請文件》的電子文件（以rar.或zip.形式壓縮后上傳，請注意無(wú)需加密）。
　　The Electronic Documents shall include the scanned copy in PDF of the full set of the original Application Document and the required PPT file.Applicants shall submit Electronic Documents by clicking the“tender document”button on the this Project’s webpage and uploading via on SITC website.(Please do not encrypt the uploaded compressed file in rar.or zip.form.)
　　5.3申請人應將紙質(zhì)《申請文件》2套（正本1套、副本1套），以專(zhuān)人送達或郵寄形式提交至上海市延安西路358號美麗園大廈14樓，收件人：欒奕，電話(huà)：021-32173720。
　　Applicants shall also submit two sets of Paper Documents of its Applicant Document(clearly mark one as“ORIGINAL”,and the another as“COPY”)by hand or by post to the following address:Mr.Luan Yi,Telephone:86-21-32173720,Address:14F,358 Yan An Road(W),Shanghai,China.
　　5.4申請人應當確保其提交的資格預審《申請文件》的電子文件和紙質(zhì)文件內容一致。當資格預審《申請文件》的電子文件與紙質(zhì)文件內容不一致時(shí)，以電子文件為準。
　　Applicants shall ensure that the contents of their Electronic and Paper Application Document submitted are consistent.In the event of any discrepancy between the Electronic Documents and the Paper Documents,the Electronic Documents shall prevail.
　　申請人提交了資格預審《申請文件》后，資格預審評審委員會(huì )將對申請人進(jìn)行綜合評審和比較，選擇6名申請人作為入圍的應征人。如申請人數量正好為6名，資格預審評審委員會(huì )將對申請人的身份和資質(zhì)、綜合實(shí)力、主創(chuàng )設計師的資歷、設計團隊的人員配置等進(jìn)行是否符合項目要求的判定。如判定符合項目要求，6名申請人直接入圍；如判定符合要求的申請人不足6名，指導單位和征集人保留重新組織資格預審的權利。如申請人少于6名，指導單位和征集人同樣保留重新組織資格預審的權利。
　　After the submission deadline of Application Document,the Prequalification Jury will conduct a comprehensive review of all Applicants and select six Applicants as Shortlisted Applicants.If there are exactly six Applicants,the Prequalification Jury will determine whether these Applicants meet the requirements of this Project by reviewing their identity and qualification,comprehensive ability,the qualifications of the chief designers,and the staffing of the design teams,etc.If it is determined that all six Applicants have met the requirements,all six applicants will be directly shortlisted;if less than six Applicants are determined to have met the requirements,the Supervisor and Sponsor reserve the right to reorganize the Prequalification.If there are fewer than six Applicants,the Supervisor and Sponsor also reserve the right to reorganize the Prequalification.
　　7.1概念方案成果經(jīng)評審符合《設計任務(wù)書(shū)》要求但未進(jìn)入前3名的3名應征人將各獲得方案征集費人民幣100萬(wàn)元（含稅）。
　　The three applicants who did not make it to the top three,those whose deliverables of this Project are evaluated to have met the requirements set in the Design Program will receive a Scheme Solicitation Fee of RMB1,000,000.00(tax included).
　　7.2進(jìn)入前3名的應征人如提交了滿(mǎn)足《設計任務(wù)書(shū)》要求的深化概念方案成果，將各獲得方案征集費人民幣150萬(wàn)元（含稅）。
　　The top three applicants whose deliverables of this Project are evaluated to have met the requirements set in the Design Program will receive a Scheme Solicitation Fee of RMB1,500,000.00(tax included).
　　7.3如征集人繼續委托優(yōu)勝單位進(jìn)行后續設計工作，且雙方達成協(xié)議，簽訂了設計（或設計咨詢(xún)）合同，優(yōu)勝單位的方案征集費包含在后續設計費或設計咨詢(xún)費中，征集人不向優(yōu)勝單位單獨支付方案征集費。
　　If the Sponsor continues to entrust the winner with subsequent design work,and both parties reach an agreement and sign a design(or design consulting)contract,the winner’s scheme solicitation fee will be included in the subsequent design(or design consulting)fee.The Sponsor shall not separately pay the scheme solicitation fee to the winner.

　　申請人提交資格預審《申請文件》即視為接受以下知識產(chǎn)權條款。
　　Once submitting the Application Document,Applicants shall be deemed to have accepted the following terms of the intellectual property rights.
　　10.1應征人承諾其擁有其提供服務(wù)時(shí)編制的所有圖紙、說(shuō)明、電子文檔和其它相關(guān)文件（以下總稱(chēng)“成果文件”）的合法權利和知識產(chǎn)權。
　　The Shortlisted Applicant shall guarantee that it has the legal rights and intellectual property rights of all drawings,descriptions,electronic files and other relevant documents(hereinafter referred to as"Deliverables")prepared when it provides services.
　　10.2應征人為本項目編制的成果文件系專(zhuān)用于本項目，各方均不得超過(guò)此范圍使用。
　　The Deliverables prepared by the Shortlisted Applicant are exclusively for this Project and shall not be used by any party beyond this scope.
　　10.3所有由應征人編制的成果文件，其著(zhù)作權歸應征人所有。如果項目在方案征集后終止，征集人聘用其他設計師來(lái)完成方案征集階段以后的工作，或應征方案未中選，征集人不可將未中選人的成果文件用于本項目后續各階段的設計。在征集人向應征人付清本公告第7條定義的方案征集費之后，指導單位和征集人可對應征人提交的成果文件進(jìn)行印刷、出版和展覽，可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式對成果文件進(jìn)行評價(jià)、展示和宣傳，但應注明應征人的名稱(chēng)。如征集人需在本次方案征集以后修改或實(shí)施應征人的成果文件，則征集人和應征人將另行簽訂后續設計（或設計咨詢(xún)）合同。
　　The Shortlisted Applicant has the copyright of its Deliverables.If the Project is terminated after the scheme solicitation,or the Sponsor entrusts other designers to complete the work after the solicitation,or the Shortlisted Applicant does not win,the Sponsor shall not use the Deliverables of unselected candidates for the design of subsequent stages of the project.After the full payment of the Scheme Solicitation Fee defined in Article 7 of the Prequalification Announcement,the Supervisor and Sponsor have the right to print,publish and exhibit the Deliverables and to evaluate,display and publicize the Deliverables through media,professional magazines,book and other forms,but the name of the Shortlisted Applicant shall be indicated.If the Sponsor needs to revise or implement the Deliverables after this Project,the Sponsor and the Shortlisted Applicant will sign a follow-up design(or design consulting)contract separately.
　　10.4應征人應保證提交的成果文件在中國境內或境外沒(méi)有且不會(huì )侵犯任何其他人的知識產(chǎn)權（包括但不限于著(zhù)作權、專(zhuān)利權）或專(zhuān)有技術(shù)或商業(yè)秘密。應征人應保證，如其成果文件使用或包含任何其他人的知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密，應征人已經(jīng)獲得權利人的合法、有效、充分的授權。應征人因侵犯他人知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密所引起的全部法律責任應由應征人承擔。
　　The Shortlisted Applicant shall ensure that its Deliverables does not and will not infringe the intellectual property rights(including but not limited to copyright and patent right)or proprietary technology or trade secrets of any other person within or outside China.The Shortlisted Applicant shall guarantee that if its Deliverables uses or contains the intellectual property rights,proprietary technology or trade secrets of any other person,the Shortlisted Applicant has obtained the legal,effective and sufficient authorization of the owner.The Shortlisted Applicant shall be liable for all legal responsibilities arising from its infringement of others'intellectual property rights,proprietary technology or trade secrets.
　　11.1資格預審公告使用中文和英文書(shū)寫(xiě)。當中、英文兩種語(yǔ)言的意思表達不一致時(shí)，以中文為準。
　　The Prequalification Announcement is written both in Chinese and English.In case of inconsistency between Chinese and English,Chinese shall prevail.
　　11.2凡參加本次資格預審的申請人均被視為同意并接受《資格預審文件》的全部?jì)热菁皸l款。
　　All Applicants participating in this prequalification are deemed to agree and accept all the contents and terms of the Prequalification Document.
　　11.3申請人在資格預審《申請文件》中所列出的主創(chuàng )設計師須親自開(kāi)展本項目的設計工作，須參加項目啟動(dòng)會(huì )與現場(chǎng)踏勘，須參加各階段的方案匯報。因此，請所列出的主創(chuàng )設計師根據征集活動(dòng)時(shí)間安排提前預留時(shí)間、做好準備。如因旅行限制原因，例如全球或區域流行病疫情等，主創(chuàng )設計師確實(shí)無(wú)法赴現場(chǎng)參會(huì )的，須在資格預審《申請文件》中進(jìn)行說(shuō)明，并承諾將通過(guò)視頻或電話(huà)會(huì )議的方式參會(huì )。所述情況將在資格預審評審時(shí)予以綜合考慮。
　　The chief designer listed in the Application Document must carry out the design work,attend the Kick-off Meeting,participate in Site Visit and present the Deliverables at each stage IN PERSON.Therefore,please make well preparation in advance according to the Schedule of Solicitation.If the chief designer is indeed unable to attend the meetings on site in the event of travel restrictions such as global or regional epidemics,he or she should make an explanation in the Application Document and promise to attend meetings by video or telephone.It will be taken into consideration by the Prequalification Jury.
　　11.4本次征集活動(dòng)及相關(guān)文件的最終解釋權歸指導單位和征集人。
