　　Chapter I Announcement on Prequalification
　　德州市自然資源局作為主辦單位，德州溝盤(pán)河片區綜合開(kāi)發(fā)有限公司作為承辦單位現舉辦“德州市溝盤(pán)河片區城市設計方案國際征集”活動(dòng)。本次方案征集活動(dòng)將公開(kāi)邀請具有相關(guān)規劃設計經(jīng)驗的設計機構前來(lái)申請應征，提交資格預審申請文件（以下簡(jiǎn)稱(chēng)“申請文件”）。通過(guò)資格預審選取4個(gè)應征人參加征集活動(dòng)，并提交應征設計成果。
　　Dezhou Natural Resources Bureau,as the Sponsor,and Dezhou Goupanhe Area Comprehensive Development Co.,Ltd.,as the Organizer,are currently holding the“International Solicitation of Urban Design Proposals for the Goupanhe Area in Dezhou City.”Design entities worldwide with related planning and design experience are publicly invited to participate and submit the Application Documents for Prequalification(hereinafter referred to as“Application Documents”).The Sponsor will select four final applicants as Participants for solicitation of proposals and for them to further submit their design proposals for response.

　　1.1項目名稱(chēng)：德州市溝盤(pán)河片區城市設計方案國際征集
　　1.1 Project Name:International Solicitation of Urban Design Proposals for the Goupanhe Area in Dezhou City
　　1.2項目位置：該項目位于東風(fēng)路以南、岔河東大道以東、減河以西。
　　1.2 Project location:The Project is located in the south of Dongfeng Road,east of Chahedong Avenue,and west of Jianhe River.
　　1.3規劃設計范圍：本次規劃范圍包含兩個(gè)空間層次：一是總體城市設計范圍，總占地面積約26.12平方公里，為德州市南部溝盤(pán)河片區；二是核心區范圍，核心區占地面積13.13平方公里，為水系周邊及城市軸線(xiàn)重要區域。
　　1.3 Planning and design scope:The planning scope of this Project includes two spatial levels:First,the overall urban design scope,covering a total area of approximately 26.12 square kilometers,focuses on the Goupanhe Area in the south of Dezhou City.Second,the scope of core area,covering an area of 13.13 square kilometers,focuses on important regions around the water system and along the urban axis.
　　1.4規劃設計任務(wù)：重點(diǎn)研究規劃定位，發(fā)展目標、產(chǎn)業(yè)研究、空間布局、發(fā)展模式等方面，主要內容包含不僅限以下內容：根據現狀條件和區域分析，明確規劃區的定位；提供國際案例借鑒分析，明確發(fā)展目標和發(fā)展策略/設計理念；優(yōu)化功能分區，細化核心片區用地布局；劃定城市生態(tài)格局；研究規劃區總體城市風(fēng)貌和設計形態(tài)；規劃城市天際線(xiàn)；確定重點(diǎn)區域建筑設計意向及標志性建筑物、構筑物設計意向；按要求進(jìn)行重要公共服務(wù)設施及大型市政服務(wù)設施布局；進(jìn)行綜合交通研究，處理好水系與車(chē)行、步行交通的有機銜接。
　　1.4 Design Specifications:To focus on planning and orientation,development objectives,industrial research,spatial layout,and development mode,including,without limitation:defining the orientation of the planned area based on the current situation and regional analysis;providing international case studies and clarifying development objectives and development strategies/design concepts;optimizing functional zoning,refining the land layout of core areas;demarcating the urban ecological pattern;studying the overall urban landscape and design form of the planned area;planning the city skyline;determining the architectural design intention in key areas and the design plans for iconic buildings or structures;identifying layout of important public service facilities and large municipal service facilities as required;and conducting integrated traffic research,to properly ensure the organic connection between water systems,vehicle lanes,and pedestrian traffic.

　　4.應征申請人的資格
　　4.Eligibility and Qualifications of Applicants
　　4.1應征申請人（以下簡(jiǎn)稱(chēng)“申請人”）應為合法注冊的法人實(shí)體或由合法注冊的法人實(shí)體組成的項目聯(lián)合體，且應具有與本項目的功能性質(zhì)相類(lèi)似的設計經(jīng)驗和策劃經(jīng)驗。
　　4.1 The Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws,and shall have design and planning experience in a project with the similar functional nature of this Project.
　　4.2應征申請人應具有承擔本征集項目城鄉規劃或建筑設計以及風(fēng)景園林設計的相應資質(zhì)或資格，同時(shí)須具有產(chǎn)業(yè)發(fā)展研究和商業(yè)運營(yíng)策劃的專(zhuān)業(yè)技術(shù)能力。
　　4.2 Applicants shall have the corresponding eligibility or qualifications to undertake urban and rural planning,or architectural design and landscape design of this Project,and shall also have professional technical capabilities in industrial development research and commercial operation planning.
　　4.2.1城鄉規劃或建筑設計以及風(fēng)景園林設計的相應資質(zhì)或資格要求如下：
　　4.2.1 The requirements for the corresponding eligibility or qualifications to undertake the urban and rural planning,or architectural design and landscape design are as follows:
　?。?）中華人民共和國境內的設計機構應具有政府有關(guān)行政主管部門(mén)核發(fā)的：城鄉規劃編制甲級資質(zhì)或建筑行業(yè)（建筑工程）設計甲級資質(zhì)或風(fēng)景園林工程設計專(zhuān)項甲級資質(zhì)或工程設計綜合甲級資質(zhì)；
　?。?）Design entities within the People’s Republic of China should possess the following qualifications issued by the relevant administrative departments of the government:Grade-A qualification for urban and rural planning,or Grade-A qualification for architectural design(architectural engineering),or Grade-A qualification for landscape engineering design or Grade-A qualification for comprehensive engineering design.
　?。?）中華人民共和國境外的設計機構應依其所屬?lài)蛩鶎俚貐^的管理規定具有城市規劃或建筑設計或風(fēng)景園林設計的執業(yè)許可或經(jīng)營(yíng)許可。
　?。?）Design entities outside the People's Republic of China should have a practice license or business license for urban planning or architectural design or landscape design in accordance with the national or local administrative regulations.
　　4.2.2產(chǎn)業(yè)發(fā)展研究和商業(yè)運營(yíng)策劃專(zhuān)業(yè)技術(shù)能力要求如下：
　　4.2.2 The requirements for professional technical capabilities in industrial development research and commercial operation planning are as follows:
　　應征申請人應具有產(chǎn)業(yè)發(fā)展研究和商業(yè)運營(yíng)策劃的項目業(yè)績(jì)，并能提供與此相關(guān)的證明資料。
　　Applicants shall have project achievements in industrial development research and commercial operation planning,and be able to provide relevant supporting materials.
　　4.3香港、澳門(mén)特別行政區和臺灣地區的規劃設計機構的資格要求參照境外設計機構資格要求的規定。
　　4.3 The qualifications for planning and design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
　　4.4本項目接受聯(lián)合體應征。
　　4.4 This Project accepts applications from Consortia.
　　4.4.1聯(lián)合體的各成員應共同簽署一份聯(lián)合體協(xié)議。
　　4.4.1 Members of a Consortium shall jointly sign a consortium agreement.
　　4.4.2組成項目聯(lián)合體的各成員單位不得再以自己的名義單獨申請資格預審，也不得同時(shí)加入本項目其它聯(lián)合體申請資格預審。
　　4.4.2 Any partner of the Consortium shall neither individually apply for the Prequalification in its own capacity,nor concurrently apply for the Prequalification as a partner of another Consortium.
　　4.5除聯(lián)合體內部的成員外，參加征集的應征人之間不應存在關(guān)聯(lián)關(guān)系。
　　4.5 Except for partners of a Consortium,the Participants in the solicitation shall not constitute or bear any affiliations.
　　5.資格預審文件的獲取

　　本項目的資格預審文件在北京科技園拍賣(mài)招標有限公司網(wǎng)站下載。
　　The Prequalification Documents for this Project can be downloaded from the website of Beijing Science Park Auction&Tender Co.,Ltd.
　　有意向參加應征的申請人需先在北京科技園拍賣(mài)招標有限公司網(wǎng)站（www.bkpmzb.com）下載資格預審文件領(lǐng)取登記表，填寫(xiě)完成后以Word版本E-mail至征集指定郵箱kjysanbu 163.com或遞交至北京科技園拍賣(mài)招標有限公司，承辦單位收到登記表后，再將資格預審文件的下載密碼發(fā)送給申請人。
　　Applicants who intend to participate in the solicitation for design proposals must first download the registration form from the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com).After completing the registration form,applicants should email the Word version to kjysanbu 163.com or submit it to Beijing Science Park Auction&Tender Co.,Ltd.After receiving the registration form,the Organizer will send the download password of the Prequalification Documents to the applicants.
　　獲取資格預審文件的時(shí)間為2023年6月5日至2023年6月10日17:00（中國北京時(shí)間，下同）。北京科技園拍賣(mài)招標有限公司網(wǎng)站將于2023年6月5日開(kāi)通。
　　The time for obtaining Prequalification Documents is from Jun.5th,2023 to 17:00 on Jun.10th,2023(Beijing Time,the same below).The website of Beijing Science Park Auction&Tender Co.,Ltd.will be accessible on Jun.5th,2023.
　　6.申請文件的遞交
　　6.Submission of Application Documents
　　申請文件遞交的截止時(shí)間為2023年6月16日下午17時(shí)00分，申請人應在遞交截止時(shí)間之前將申請文件遞交至征集組織機構。主辦單位和征集組織機構將拒絕接收逾期送達的申請文件。
　　The deadline for submission of application documents is 17:00 on Jun.16th,2023.Applicants shall submit such documents to the Organizer of Solicitation before the deadline.The Sponsor and the Organizer of Solicitation will reject any such documents that arrive after the specified deadline.

　　7.Media Releasing Announcement on Prequalification
　　本公告在中國招標投標公共服務(wù)平臺（www.cebpubservice.com）、中國政府采購網(wǎng)（www.ccgp.gov.cn）、北京科技園拍賣(mài)招標有限公司網(wǎng)站（www.bkpmzb.com）同時(shí)發(fā)布。本公告的修改、補充以在以上網(wǎng)站發(fā)布的內容為準。
　　This announcement will be published on the China Tendering and Bidding Public Service Platform(www.cebpubservice.com),China Government Procurement Network(www.ccgp.gov.cn),and the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com)at the same time.The amendment and supplement of the announcement shall be subject to the contents released via the websites aforementioned.

　　8.1知識產(chǎn)權
　　8.1 Intellectual Property Rights(IPRs)
　　8.1.1本次方案征集中接收的所有有效的應征文件（包括A3版面設計文冊、A0標準輕質(zhì)展板、電子文件、模型和應征設計方案著(zhù)作權聲明等）均不退回。
　　8.1.1 All valid response proposals(including the A3 sized design book,A0 standard lightweight exhibition panel,electronic documents,models,and the Copyright Statement of Design Proposals)received in this solicitation will not be returned.
　　8.1.2應征設計文件和設計成果的知識產(chǎn)權由主辦單位/承辦單位與應征人共同享有。
　　8.1.2 The intellectual property rights of the Design Proposals and design results shall be commonly owned by the Sponsor/Organizer and the Participants.
　　8.1.3應征人對其應征設計文件享有署名權，在征得主辦單位/承辦單位書(shū)面同意后可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評價(jià)、展示其應征設計文件的相關(guān)內容。除應征人的設計標準、設計導則和繪圖元素以外，應征人不得將應征設計文件及設計成果用于其他的設計項目。
　　8.1.3 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications,trade magazines,publications among others after granted with the Sponsor’s/Organizer’s consent in writing.The Participants shall not use the Design Proposals and design results on other design projects,except the Participants’design standards,design guides and principles,and drawing elements.
　　8.1.4應征人應保證提交的應征設計文件及設計成果在中華人民共和國境內或境外沒(méi)有且不會(huì )侵犯任何其他人的知識產(chǎn)權（包括但不限于著(zhù)作權、專(zhuān)利權）或專(zhuān)有技術(shù)或商業(yè)秘密。應征人應保證，如果其應征設計文件使用或包含任何其他人的知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密，應征人應已經(jīng)獲得權利人的合法、有效、充分的授權。應征人因侵犯他人知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密所引起的全部賠償責任應由應征人承擔。
　　8.1.4 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patent right)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others,the Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or know-how or trade secrets of others.
　　8.1.5主辦單位/承辦單位有權在本項目的規劃設計中使用應征人提交的規劃設計成果，主辦單位/承辦單位在項目的規劃設計中或在規劃設計方案調整綜合時(shí)可以全部或部分使用應征規劃設計成果的內容，也可以對其進(jìn)行修改。主辦單位/承辦單位不得將應征設計文件及設計成果用于本項目以外的其他項目。
　　8.1.5 The Sponsor/Organizer has the right to use the planning and design results submitted by the Participants in the planning and design of this Project.The Sponsor/Organizer is allowed to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and has the right to modify them.The Sponsor/Organizer shall not use the Design Proposals and designresults for a purpose other than this Project.
　　8.1.6主辦單位/承辦單位可以對所有應征設計文件及設計成果印刷、出版和展覽，并可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評價(jià)、展示、宣傳應征設計文件及設計成果，但應注明設計機構的名稱(chēng)。
　　8.1.6 The Sponsor/Organizer can print,publish and exhibit all the Design Proposals and design results,or comment on,display and publicize the Design Proposals and design results via media communications,trade magazines,publications or by other means.The precondition is indication of the names of design entities for such design.
　　8.1.7應征建筑設計方案（如果有）的著(zhù)作權歸屬于應征人，但景觀(guān)小品及其建構筑物除外。
　　8.1.7 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.
　　8.2應征設計補償金
　　8.2 Compensations for Designs Proposals
　　承辦單位將向按征集文件的要求在規定的時(shí)間內提交了有效應征文件的應征人支付應征設計補償金，金額為人民幣80萬(wàn)元（含稅）。當應征人出現下列情況時(shí)，承辦單位將不予支付補償金：
　　The Organizer will pay compensations for design proposals in the amount of RMB 0.8 million(including tax)for any Participant that has submitted valid responsive documents within specified time frame as required per Solicitation Documents.The Organizer will not pay any compensation when Participants are under any of the following circumstances:
　?。?）應征人未按規定時(shí)間提交應征文件；
　?。?）Participants fail to submit their response proposals within the specified time;
　?。?）應征人提交的應征文件經(jīng)專(zhuān)家委員會(huì )評審被認定為未對征集文件要求作出實(shí)質(zhì)性響應；
　?。?）The response proposals submitted by Participants are judged,upon the expert review,as not substantially responding to the requirements of the Solicitation Documents;
　?。?）應征人被取消應征資格。
　?。?）Participants are disqualified.
　　8.3獎項的設置
　　8.3 Awards settings
　　本次方案征集將評選出2個(gè)優(yōu)勝設計方案，其應征設計方案被選為優(yōu)勝方案的2個(gè)應征人須根據主辦單位/承辦單位的優(yōu)化設計要求對其提交的設計方案進(jìn)行優(yōu)化，優(yōu)化費用為人民幣20萬(wàn)元（含稅）。
　　There will be two winning design proposals in this solicitation.The two Participants whose design proposals are selected as the winning proposals must optimize their respective design proposals according to the requirements of the Sponsor/Organizer.The optimizing fee is RMB 200,000(including tax).
　　8.4適用法律
　　8.4 Governing laws
　　本次征集活動(dòng)本身及與本次活動(dòng)相關(guān)的文件所適用的法律和法規僅為中華人民共和國的法律和法規。
　　The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
　　8.5語(yǔ)言
　　8.5 Languages
　　資格預審文件以及與資格預審文件相關(guān)的補充文件和澄清文件均使用中文和英文書(shū)寫(xiě)。申請文件應使用中文書(shū)寫(xiě)，申請人隨申請文件提供的證明文件和印刷品可以使用另一種語(yǔ)言，但應附中文譯本。在中文與其他語(yǔ)言的意思表達不一致時(shí)，以中文為準。
　　The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English.Application Documents for Prequalification shall be drafted in Chinese.Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents,but the version with Chinese translation shall be attached thereto.In the case of inconsistent expressions in both Chinese and another language,the Chinese version shall prevail.

　　8.6 Power of interpretation
　　本次征集活動(dòng)的最終解釋權歸主辦單位和承辦單位。

　　The Sponsor and the Organizer reserve the power of final interpretation in view of the solicitation.
