　　The entities participating in the International Solicitation should select a key area of 1.0 square kilometer for in-depth urban design and expression according to the urban design proposal.The level of details should meet the requirement of urban design at the site plan stage.

　　4.應征申請人的資格
　　Eligibility and Qualifications of Applicants
　　4.1應征申請人（以下簡(jiǎn)稱(chēng)“申請人”）應為合法注冊的法人實(shí)體或由合法注冊的法人實(shí)體組成的項目聯(lián)合體。
　　4.1 Any prequalification Applicant(hereinafter referred to as"Applicant")shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.
　　4.2申請人應具有承擔本征集項目規劃設計的專(zhuān)業(yè)技術(shù)能力。
　　4.2 Applicants shall have the professional and technical ability to undertake the planning design of this solicitation project.
　　4.2.1中華人民共和國境內的申請人應具有城鄉規劃編制甲級或工程設計建筑行業(yè)（建筑工程）甲級及以上資質(zhì)。
　　4.2.1 Applicants within the People's Republic of China should have a qualification certificate of Grade A for urban and rural planning or a qualification certificate of Grade A for architectural design(architectural engineering)or above.
　　4.2.2中華人民共和國境外的申請人須依所在國或所在地區的管理規定具有城鄉規劃或城市設計或建筑設計的執業(yè)許可或經(jīng)營(yíng)許可。
　　4.2.2 The Applicants outside the People's Republic of China should have a practice license or business license for urban and rural planning,urban design,or architectural design in accordance with the national or local administrative regulations.
　　4.3中華人民共和國境外的申請人須與境內的申請人組成聯(lián)合體。
　　4.3 Any Applicant outside the People's Republic of China shall form a Consortium with an Applicant inside the People's Republic of China.
　　4.4香港、澳門(mén)特別行政區和臺灣地區的設計機構的資格要求參照境外設計機構資格要求的規定。
　　4.4 The qualifications for design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
　　4.5本項目接受聯(lián)合體申請。聯(lián)合體成員的數量不超過(guò)三個(gè)，組成項目聯(lián)合體的各成員單位不得再以自己的名義單獨申請資格預審，也不得同時(shí)加入本項目其它聯(lián)合體申請資格預審，本項目不接受自然人及自然人組合的申請。
　　4.5 This Project accepts applications from a Consortium.The number of members of a Consortium should not exceed three.Any partner of the Consortium shall neither individually apply for the prequalification in its own capacity,nor concurrently apply for the prequalification as a partner of another Consortium.This Project does not accept applications from natural persons or combinations of natural persons.
　　4.6除聯(lián)合體內部的成員外，參加本次國際征集的應征人之間不應存在關(guān)聯(lián)關(guān)系。
　　4.6 Except for partners of a Consortium,Participants in the International Solicitation shall not constitute or bear any affiliations.

　　8.1 Intellectual Property Rights(IPRs)
　　8.1.1本次國際征集中接收的所有有效的應征文件（包括A3版面設計文冊、電子文件、展板、模型和應征規劃設計成果著(zhù)作權聲明等）均不退回。
　　8.1.1 Any valid response proposals(including A3 sized design books,electronic documents,exhibition panels,models,and Copyright Statement of planning and design proposals)received in the International Solicitation will not be returned.
　　8.1.2應征人對其設計成果享有署名權，在征得主辦單位/承辦單位書(shū)面同意后可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評價(jià)、展示其設計成果的相關(guān)內容。除應征人的設計標準、設計導則和繪圖元素以外，應征人不得將設計成果用于其他的設計項目。
　　8.1.2 Participants hold the right of authorship for their design results and can comment on and display such design results in the forms of media communications,trade magazines,publications among others after granted with the Sponsor/Organizers’consent in written form.Except for Participants'design standards,designing guidelines,and drawing elements,Participants shall not use their design results in other design projects.
　　8.1.3應征人應保證提交的設計成果在中國境內或境外沒(méi)有且不會(huì )侵犯任何其他人的知識產(chǎn)權（包括但不限于著(zhù)作權、專(zhuān)利權）或專(zhuān)有技術(shù)或商業(yè)秘密。應征人應保證，如果其設計成果使用或包含任何其他人的知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密，應征人應已經(jīng)獲得權利人的合法、有效、充分的授權。應征人因侵犯他人知識產(chǎn)權或專(zhuān)有技術(shù)或商業(yè)秘密所引起的全部賠償責任應由應征人承擔。
　　8.1.3 Participants shall ensure that all submitted design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patents)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.Participants shall guarantee that if their design results use or include IPRs or proprietary technologies or trade secrets of others,Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.Participants shall take all liabilities for any compensations arising from infringement upon IPRs or know-how or trade secrets of others.
　　8.1.4主辦單位/承辦單位有權在本項目的規劃設計中使用應征人提交的設計成果，主辦單位/承辦單位在項目的規劃設計中或在規劃設計方案調整綜合時(shí)可以全部或部分使用設計成果的內容，也可以對其進(jìn)行修改。主辦單位/承辦單位不得將設計成果用于本項目以外的其他項目。
　　8.1.4 The Sponsor/Organizers have the right to use the design results submitted by Participants in the planning and design of this Project.The Sponsor/Organizers are allowed to use the design results in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and have the right to modify them.The Sponsor/Organizers shall not use the design results for a purpose other than this Project.
　　8.1.5主辦單位/承辦單位可以對所有設計成果印刷、出版和展覽，并可通過(guò)傳播媒介、專(zhuān)業(yè)雜志、書(shū)刊或其他形式評價(jià)、展示、宣傳應征規劃設計成果，但應注明應征規劃設計機構的名稱(chēng)。
　　8.1.5 The Sponsor/Organizers can print,publish and exhibit all the design results,or comment on,display and publicize the planning and design proposals via media communications,trade magazines,publications or by other means.The precondition is indication of the names of the planning and design entities for such design.
　　8.1.6建筑設計方案（如果有）的著(zhù)作權歸屬于應征人，但景觀(guān)小品及其建構筑物除外。
　　8.1.6 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.
　　8.2應征設計補償金
　　8.2Compensations for Design Proposals
　　承辦單位將向按征集文件的要求在規定的時(shí)間內提交了有效應征文件的應征人支付應征設計補償金，金額為人民幣230萬(wàn)元（含稅）。當應征人出現下列情況時(shí)，承辦單位不予支付補償金：
　　The Organizers will pay compensations for Designs Proposals to Participants who have submitted valid response proposals at the specified time in accordance with the requirements of the Solicitation Documents.The amount is RMB 2.3 million(including tax).The Organizers will not pay any compensation when Participants are under any of the following circumstances:

　?。?）應征人提交的應征文件經(jīng)專(zhuān)家委員會(huì )評審被認定為未對征集文件要求作出實(shí)質(zhì)性響應；
　?。?）應征人被取消應征資格。
　?。?）Participants fail to submit their response proposals within the specified time;
　?。?）The response proposals submitted by Participants are judged,upon the expert review,as not substantially responding to the requirements of the Solicitation Documents;

　　8.3獎項的設置
　　8.3 Awards settings
　　本次國際征集將通過(guò)專(zhuān)家評審選出2個(gè)優(yōu)勝應征規劃設計成果，不排序。隨后主辦單位會(huì )將本次國際征集的優(yōu)勝應征規劃設計成果和其他應征設計成果向公眾進(jìn)行展示，接收社會(huì )各界的意見(jiàn)和建議，最終通過(guò)綜合評估，確定排序第一和排序第二的優(yōu)勝應征規劃設計成果。排序第一的優(yōu)勝應征規劃設計成果的應征人可獲得獎金人民幣90萬(wàn)元（含稅），排序第二的優(yōu)勝應征規劃設計成果的應征人可獲得獎金人民幣50萬(wàn)元（含稅）。
　　The International Solicitation will select two winning planning and design proposals through expert review,with no ranking.After that,the Sponsor will publicize the winning planning and design proposals and other response proposals in the International Solicitation,receive opinions and suggestions from all walks of life,and finally determine which winning proposal ranks first and which ranks second through comprehensive evaluation.The Participant that ranks first for the winning planning and design proposals will be rewarded RMB 0.9 million(including tax),and the Participant that ranks second will be rewarded RMB 0.5 million(including tax).
　　8.4后續工作
　　8.4 Follow-up work
　　主辦單位將委托獲得優(yōu)勝應征規劃設計成果的應征人完成本項目的城市設計方案綜合和控制性詳細規劃的編制，總費用人民幣595萬(wàn)元（含稅），其中城市設計方案綜合費用為人民幣290萬(wàn)元（含稅），控制性詳細規劃編制費為人民幣305萬(wàn)元（含稅）。
　　The Sponsor will entrust the Participant whose planning and design proposal is selected as the winning proposal to complete the development of the general and regulatory plans for the urban design proposal of this Project,with a total cost of RMB 5.95 million(including tax),including the expenses for the integration of urban design proposals of RMB 2.90 million(including tax),and the expenses for the preparation of regulatory plans of RMB 3.05 million(including tax).

　　本次征集活動(dòng)的最終解釋權歸主辦單位/承辦單位。
